How long does it take to get a divorce in New York?

This depends on your case but typically the process takes about 90 days.

Do I need to have a separation agreement for 1 year prior to filing for a divorce?
Answer:
Only if you want to file a no fault divorce. You can still get a divorce if you file with grounds, this is what most people do if they do not want to wait.

Can I get a divorce if I do not know where my spouse is?
Answer:
Yes, you will need to serve via publication, the process is slightly different but you can still get a divorce and we can assist you.
Question:
Are there other costs other then the $149.95 for having the papers prepared?
Answer:
Yes, there is a court filing fee. If you are considered low income, you can have the court fees waived. The filing fee is around $125.00.
Question:
What if my spouse will not sign the papers?
Answer:
You will do what is called a default divorce. We can assist you with this, the process is slightly different but we do not charge you extra for this service.

Is this legal?
Answer:
Yes, this is legal. What makes a document legal is when a judge signs. We use only New York Court approved forms so you are assured they will be accepted by the court.

Do you offer a guarantee?
Answer:
Yes, we offer a guarantee that our forms that we prepare will be accepted by the court as far as format goes. If you want something put in the forms that a judge will not consider “fair” we are not responsible. We are responsible for the forms as far as format and clerical accuracy. Please note that we have never had our forms rejected.
