Whether you have decided to file for a no fault New York divorce or a New York divorce with grounds, the process is fairly simple. It is important to remember that the single most important element to getting your divorce finalized in the court is that you have the correct forms and they are filled out properly. If you don’t have the correct forms, are missing forms, or the forms are not filled out correctly, they will not be accepted by the court. Further, the court clerk will not explain what is wrong with the documents.
Step One
Upon receiving your divorce papers you will need to sign and notarize them and make two copies of each form. It is important that you keep your forms in order and keep them clean and neat otherwise the court may not accept them.
Step Two
Once you have your divorce papers signed, notarized, and have your copies you will head to the courthouse. Some courts will allow you to file your papers by mail. If you do this it is important that you enclose the filing fee or filing fee waiver forms and a self addressed stamped envelope so the court can mail you back the copies of the filed documents.
Step Three
After you have filed your documents you will either have your spouse served (if this is not an agreed divorce) or you will need to contact the court if they have not contacted you to find out when you can appear before the judge and file your final papers.
Step Four
You will either go to court for your brief appearance before the judge with your final papers in hand or you will file the final papers and wait to be contacted back from the court. Once you have your judge signed final decree/judgment of divorce in your hand, that’s it, you are officially divorced.
